Expert Witnessing & Ethics 

Speakers:

Abstract:

"A topical panel discussion on key aspects regarding-
How to be an Expert Witness; how to collect, collate and interpret failure
investigation data; preservation of evidence, matters pertaining to professional Ethics; and perhaps most importantly the critical Legal aspects from the Lawyers viewpoint.
The panel will provide guidance and show various illustrative case histories, highlighting what one might expect in this difficult but very interesting subject. The talks will be followed by an expected lively Q/A session".

David Hendrix is President of The Hendrix Group Inc., a materials engineering consulting company in Houston TX.   David has more than 29 years of consulting experience in the related areas of materials selection, corrosion investigations and failure analysis of metals and non-metals.  When these same investigations have taken a legal turn, David has acted both as a testifying expert and consulting expert in more than 25 cases.  This legal experience has included legal research, depositions, expert reports and trial testimony. 

Mark A. Waite is a partner at the law firm of Beirne, Maynard & Parsons, L.L.P.  He practices exclusively in civil trial and litigation law, and is Board Certified in Civil Trial Law by the Texas Board of Legal Specialization.   Mr. Waite handles cases in multiple areas and industries, including energy, construction, professional risk, and general commercial litigation,  and tries cases to judges and juries in federal and state courts. Mr. Waite is a graduate of Texas A&M University and the University of Houston Law Center. Michael Burns is a consultant with Metallurgical Consultants, Inc.  He works primarily in material selection and failure analysis of oilfield, offshore, and industrial equipment.  He was involved extensively in the investigation of the Ocean Baroness riser failure and the subsequent lawsuit.  He has BS and MS degrees in metallurgical engineering from the Colorado School of Mines and an M. Div. degree from Wartburg Theological Seminary.  In addition to his work at Metallurgical Consultants, Inc., Mike is an ordained pastor in the Evangelical Lutheran Church in America.
